1. TO ENTER: Enter online at http://www.exploresc.com or http://www.exploresc.ca For eligibility, entries must be received between 11:59 a.m. EST November 2, 2007 through May 1, 2008 at 11:59 p.m. EST. Sponsor is not responsible for unsuccessful online attempts. LIMIT: There is a limit of one (1) entry per email address. Any use of agencies or robotic, repetitive, automatic, programmed or similar entry methods will void all entries by that entrant. No mail or facsimile entries will be accepted. All entries become the property of the South Carolina Department of Parks, Recreation and Tourism and will not be returned or acknowledged.
2. PRIZE AND APPROXIMATE RETAIL VALUE: One (1) 160 GB Apple video iPod valued at $349.00 U.S. will be awarded to a randomly selected United States household and One (1) 160 GB Apple video iPod valued at $349.00 U.S. will be awarded to a randomly selected Canadian household.
3. ELIGIBILITY: The “Explore SC” Sweepstakes is open only to individuals who are legal residents of the United States of America or Canada and are twenty-one (21) years of age or older at the time of entry. Limit one prize per family or household. Employees of the South Carolina Department of Parks, Recreation and Tourism and any of their affiliate companies, subsidiaries, agents, and advertising and promotional agencies, as well as immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The “Explore SC” Sweepstakes is subject to all federal, provincial and municipal laws and regulations and is void where prohibited by law. South Carolina laws govern this sweepstakes.
4. SPONSOR: The “Explore SC” Sweepstakes is sponsored by the South Carolina Department of Parks, Recreation and Tourism (“Sponsor”).
5. AGREEMENT TO OFFICIAL RULES: Participation in the Savor South Carolina Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein in a timely manner.
6. ENTRY PERIOD: The Savor South Carolina Sweepstakes will accept entries from 11:59 a.m. EST November 2, 2007 through May 1, 2008 at 11:59 p.m. EST. Entries received prior to or after the Entry Period will be disqualified.
7. DRAWING: Winners will be determined in a random drawing to be conducted on or about May 30, 2008 from all eligible entries. An independent judge whose decisions are final shall conduct random drawing. Odds of winning depend on the number of eligible entries received. Sponsor will attempt to notify the potential winner with seven (7) days of the drawing. Except where prohibited, the potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within ten (10) days of being notified, as well as answer as answer a mathematical skill testing question. If the potential winner cannot be contacted within seven (7) business days after the first attempt to contact him/her, or fails to sign and return the Affidavit/Release or answer the mathematical question within the required time period, the Sponsor will have the right to disqualify that potential winner and select an alternate potential winner in his/her place at random from all entries received. Prize winner will be notified by email and/or telephone. Once notified, winner will have twenty-four hours to respond and validate receipt.
8. REQUIREMENTS OF THE POTENTIAL WINNER: Prize is nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of equal of greater value if the prize is not available for any reason as determined by Sponsors in their sole discretion Winners are responsible for all federal, state, provincial, and/or local taxes associated with receipt of prize.
9. GENERAL CONDITIONS: Sponsor reserve the right to cancel, suspend, and/or modify the Savor South Carolina Sweepstakes if any fraud, virus, or other technical problem corrupts the administration, security, or proper play of the Savor South Carolina Sweepstakes as determined by the Sponsor in their sole discretion. In such event the Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Savor South Carolina Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Savor South Carolina Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. If, for any reason, the Sweepstakes is not capable of running as planned due to, without limitation, errors in these Official Rules or advertising for this sweepstakes, tampering, unauthorized intervention, fraud, technical failures, human error or any other cause beyond the control of the Sponsor(s), Sponsor(s) reserve the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes. By entering, entrants agree at all times to defend, indemnify, release and hold harmless the Sponsor(s) from and against any and all claims, actions, liabilities, injuries, death, accidents, losses or damages of any kind resulting directly or indirectly from any and all activity related to entering and/or participating in this Sweepstakes or from the acceptance or use of prize. Entries that are obtained through unauthorized sources are void. No substitution of prizes is permitted by winners. Prize is not for resale, can not be redeemed for cash, is not transferable or exchangeable, and can not be used in conjunction with any discount, premium, or rebate offer. Sponsor(s) reserve the right to substitute the prize with one of equal of greater value if prize is unavailable. By participating in this Sweepstakes, entrants agree to be bound by these official rules.
10. PUBLICITY: Except where prohibited, participation in the Savor South Carolina Sweepstakes constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, voice, opinions, biographical information and province of residence for promotional purposes in any media without further payment or consideration.
11. PRIVACY: All information submitted by entrants as part of this Savor South Carolina Sweepstakes will be treated in accordance with Sponsors’ Privacy Policies.
12. RELEASE: By receipt of a prize, winner agrees to release and hold harmless Sponsors and their officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Savor South Carolina Sweepstakes or receipt or use of any prize. By entering this sweepstakes, each entrant acknowledges and agrees that: (a) the entrant has opted-in to South Carolina Department of Parks, Recreation and Tourism’s privacy policy on the sweepstakes entry page; and (b) by opting-in, the entrant has read and acknowledges that if her/she is chosen as a winner, certain of his/her identifying information may be disclosed to third parties at least as required by law including without limitation, on a winner’s list.
13. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Savor South Carolina Sweepstakes; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Savor South Carolina Sweepstakes or the processing of entries; (e) lost, delayed, misdirected, or undeliverable mail; or (f) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Savor South Carolina Sweepstakes or receipt of any prize.
14. DISPUTES: Except where prohibited, entrant aggress that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Savor South Carolina Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of South Carolina; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Savor South Carolina Sweepstakes, but in no event attorneys’ fees; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited, to, punitive, consequential, direct, or indirect damages. All issues and question concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Savor South Carolina Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of South Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of South Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of South Carolina.
